I got caught growing a small marijuana plant in Pennsylvania. What should i do?
Ok. I had no major operation and they wanna charge me with a misdemeanor for possesion of a controlled substance. I just got bored one day and put a few seeds in a flower pot in my house. Now a few days ago a bike cop was harrasing me following my car around the neighborhood for no reason except maybe cause im a black male in a nice car and must figured it must be stolen. I looked out my bedroom window to see he called for backup and now a squad car was outside running my plates. Then when they saw me watching them, they pulled off. Im guessing they seen the single 6 inch marijuana plant with just leaves in my window and thought they had a major bust. Next thing i know they have about 8-10 officers/gang unit/sergant outside my house demanding to let them in. By this time i already moved the plant out the window. They then start banging on the door so i opened it. Now when i opened the door he asked me if he could come in and talk to me. I replyed "no, can i come outside and talk to you?" he replyed "No, Im coming in to talk to you about the marijuana plants" and then just pushed his way in the door.(Isnt that illegal without a search warrant?). Then they all rushed in makin threats and tryna get rough with me and just went around the house looking. After they seen the plants were not in plain sight, the officer came and asked me if it was ok to search my house and if i refuse then they will take me downtown and hold me until they get a search warrant, so then i agreed to the search. They obviosly thought they had a big case and u could tell it on their face they were dissapointed it was only a single plant. Then they asked for the car keys even though i wasnt in the car when they came and its not even registered in my name and then i thought it was illegal to break into someone's glove box if its locked even though they didnt find a single thing in the car. They took the plants (1 was alive and 5 were dead) as evidence in a paper bag saying they can charge me with 6 pounds of marijuana even though they are only about 1 month old and all were dead except one and said they will send me a court date in the mail. They asked the sergant what should they do with me and he told them he dont care, its up to the officer that mind the find. (None of them wanted to do any writeups on it, but one cop did take all my info and said i will get my summons in the mail)Do you think this could be serious? Do you think they might let it go because they knew they were in the wrong to? Should i plead guity even though they illegaly searched my house? Your story doesn't make a whole lot of sense because it does not follow the Pennsylvania Rules of Criminal Procedure. I have a hard time believing police acted in the way that they did.

The story you described, if true, would be a violation of Pennsylvania law on the part of the police officers for several reasons. Pennsylvania is different from other states because the Pennsylvania Constitution grants greater privacy protections than the rest of the country. Police are prohibited from entering your house and arresting you without a warrant. Police would need a warrant to search the vehicle, and any consent to search would not be valid given that it was obtained after arresting you within your home. For legal purposes, you were under arrest. There is no Terry Stop justified when police enter your home without a warrant.

You state that you had a total of six plants, which would constitute not only felony possession in the Commonwealth, but also would be indicative of an intent to sell. I once prosecuted a case of a marijuana grower with 6 plants as a PWID (possession with intent to deliver). If they were going to charge you with a felony, you would not get a summons in the mail, they would arrest you and you would only be released after a bail hearing and posting any bail.

Even if they charged you only with a misdemeanor K&I, (ignoring the fact that 1 lbs. constitutes a felony), you would be entitled to an attorney even if you cannot afford one.

An attorney would be able to evaluate the police report, when it is made, to determine the likelihood of winning a motion to suppress. As far as proving it was marijuana when they saw it outside, they don't need to. Their experience recognizing marijuana plants is enough to sustain a warrant. They just need probable cause, not beyond a reasonable doubt when getting a warrant. Probable cause is a fair probability that a crime has been committed and you are the person who committed the crime. The police are free to follow you around, and have that right. They do not have a right to search and seize contraband within your home without a warrant.
